Planning Scheme Amendment C125 - Footscray Structure Plan

The Footscray Structure Plan(PDF, 10MB) will guide future development for the Footscray Central Activities Area (CAA).

The plan is based on previous strategies and studies including the Footscray City Edge Masterplan, Footscray Planning Scheme Amendment C90; Footscray Skyline Study 2012; Footscray CAA Car Parking Study and the Footscray Structure Plan Background Report (all attached below).

Planning Scheme Amendment C125

Amendment C125 proposes to implement the Structure Plan into the Maribyrnong Planning Scheme.

What the amendment does:

  • Introduces the Activity Centre Zone (ACZ)(PDF, 44KB) into the planning scheme and rezones the majority of land within the Footscray CAA to ACZ.
  • Introduces Schedule 1 to the ACZ(PDF, 5MB) that defines eight precincts within the Footscray CAA and prescribes the form of development in each precinct.
  • Updates the MSS with a new local area policy for the Footscray CAA.
  • Updates the reference documents listed in the Maribyrnong Planning Scheme.
  • Deletes the Priority Development Zone for the Footscray Station Precinct and Joseph Road Precinct (replacing it with the ACZ).
  • Introduces a Parking Overlay into the planning scheme and applies Parking Overlay 1 to the inner parking precincts and applying Parking Overlay 2 to the outer parking precincts.
  • Updates the Heritage Overlay to provide individual heritage protection to 15 sites, and makes consequential changes to the local heritage policy.
  • Applies the Environmental Audit Overlay on five sites.

Amendment C125 - Public Exhibition and Council consideration of submissions

The amendment was publicly exhibited from the 25 July to the 25 August 2013. All affected land owners and occupiers were notified of the amendment and provided with an opportunity to have their say on the draft Structure Plan and the Amendment. Council held information sessions on 30 and 31 July. 71 submissions were received in response to the amendment.

The submissions were considered by Council at the City Development Special Committee meeting on 22 October 2013. At the meeting Council resolved to refer all submissions to an Independent Planning Panel.

Amendment C125 - Panel Hearing and Council Consideration of Panel Recommendations

An Independent Planning Panel has considered submissions to the amendment. The directions hearing was held on 15 November, and the panel hearing was held on the 9, 10, 11 and 13 December 2013. The Panel has released its report, which is available via the links below. The Panel predominantly supports the amendment, in particular the rezoning of the centre to Activity Centre Zone, with a range of minor changes.

The report of the Independent Planning Panel was considered by Council at the 18 March Ordinary Council Meeting. Council supported the Panel recommendations and resolved to adopt Amendment C125 with the recommended Panel revisions.

Approval

Amendment C125 was approved by the Minister for Planning on 19 March 2015. A notice was published in the Government Gazette on 19 March 2015. Please refer to Planning Scheme Amendments Online for the approved documentation.
