Planning Scheme Amendment C137 - Open Space Contributions Policy

 
Council has developed a plan to guide future provision, design and management of open space in the city. The plan, called the Open Space Strategy, is supported by changes to the planning scheme under Amendment C137.

Under the plan, development will contribute new open space or support improvements to existing parks. The plan will ensure everyone in Maribyrnong has access to high-quality open space and developers provide their fair share.

About the amendment

Planning Scheme Amendment C137 is part of the implementation of the Open Space Strategy(PDF, 9MB).

The Open Space Strategy is Council's plan to provide more open space for our growing community. Improvements to the quality, number and accessibility of our open spaces will enhance our city's liveability. The strategy was endorsed by Council on 21 October 2014, and the associated Open Space Contributions Policy was endorsed on 28 April 2015. Council adopted the Contributions Policy and Amendment C137 on 19 April 2016.

 Amendment C137 was publicly exhibited from 2 July to 3 August 2015.

Amendment approval

The Minister for Planning has approved Amendment C137. Notice of approval was published in the government gazette on 4 August 2016.

Prior to Ministerial approval, Council adopted the Amendment at its 19 April 2016 meeting.

What the amendment does

The amendment has introduced an open space contribution rate into Maribyrnong Planning Scheme. Generally speaking, a 5.7 percent open space contribution will be required (as either land or a cash payment) when subdividing land into 3 lots or more. The new local policy at Clause 22.07 identifies areas where Council prefers land contributions rather than cash contributions towards public open space (See map below). It also outlines criteria for new open space to ensure new development contributes high-quality open space that meets the community's needs. For larger subdivisions, the policy permits Council to consider requiring a greater land contribution. The policy encourages developers to consult with Council early in the development process.

Additionally, the amendment revised the Municipal Strategic Statement to update the vision for Open Space, in line with the City of Maribyrnong Open Space Strategy.

 

Planning Panel

Following public exhibition from 2 July to 3 August 2015, submissions were referred to an independent Planning Panel appointed by the Minister for Planning. The Panel Hearing was held on 9 December 2015 at Footscray Town Hall. The panel considered all submissions and has issued its report.
