Report and Consent Application Forms

Report and Consent applications may be required for approval of specific building design features that are outside the standards specified in the Building Regulations 2006.

Since 1 August 2013 Council has administered all applications for Report and Consent, to vary any Part 4 Siting Regulations of the Building Regulations 2006.

Council has the power to either consent to or refuse any variations to building standards about matters such as:

  • Building over an easement. Regulation 310(1) (report and consent for building over easements)
  • Setback from a street alignment not complying with Regulation 408(3) (maximum street setback)
  • Setback from a street alignment not complying with Regulation 409(4) (minimum street setback)
  • Building height not complying with Regulation 410(4) (building height)
  • Site coverage not complying with Regulation 411(4) (site coverage)
  • Impermeable surfaces covering more than 80% of an allotment area Regulation 412(2) (permeability)
  • Car parking spaces not complying with Regulation 413(6) (car parking)
  • Side or rear boundary setbacks not complying with Regulation 414(6) (side and rear setback)
  • Walls or carports not complying with Regulation 415(5) (walls on boundaries)
  • Building setbacks not complying with Regulation 416(6) (daylight to existing habitable room window)
  • Building setbacks not complying with Regulation 417(6) (solar access to existing north-facing windows)
  • Building reducing sunlight to adjoining recreational private open space Regulation 418(3) (overshadowing of recreational private open space)
  • Habitable room windows or raised open space not complying with Regulation 419(9) (overlooking)
  • Non complying habitable room windows on a allotment Regulation 420(3) (daylight to habitable room window)
  • Private open space not complying with Regulation 421(4) (private open space)
  • Siting of a Class 10a buildings not complying with Regulation 422(1) (siting of a class 10a buildings)
  • Front fence height not complying with Regulation 424(3) front fence height)
  • Fence setback from side side or rear boundary not complying with Regulation 425(3) Fence setback from side and rear boundaries)
  • Length or height of side or rear boundary fence not complying with Regulation 426(5) (fences on or within 150mm or a side or rear boundary)
  • Fence over 1 metre in height and within 9m of a street intersection or barbed wire on a fence. Regulation 427(1) (fences on street alignments)
  • Fence setback not complying with Regulation 428(1) (fences and daylight to windows in existing dwellings)
  • Fence setback not complying with Regulation 429(5) (fences and solar access to existing north facing habitable room windows)
  • Fence design not complying with Regulation 430(3) (overshadowing of recreational private open space)
  • Mast, pole, aerial, antenna, chimney flue pipe ect that exceeds certain height limits. Regulation 431 (Mast poles ect)
  • Projections beyond street alignment. Regulation 513(1), 513(2) (Projections)
  • Projections of a building. Regulation 515(2) (Projections above or below certain public facilities)
  • Precautions over a street. Regulation 604(4) (protection of the public)
  • Construction of buildings on land liable to flooding. Regulation 802(3) (flood areas)
  • Building on designated land or works. Regulation 806(1) (designated land or works)

The application form below must be completed and each item must be clearly indicated on this form.

In some cases Planning Approval may also be required.
