Planning Enforcement

Council’s Planning Enforcement Officers are responsible for monitoring any new developments, investigating breaches of the Maribyrnong Planning Scheme, Section 173 Agreements, conditions of a permit, or non-compliance with any endorsed plans.

Depending on the nature of the offence, Council may issue a Planning Contravention Notice or a Planning Infringement Notice, with associated penalties.

If compliance is not obtained, the matter may proceed to the Magistrates Court for prosecution, an application may be lodged with the Victorian Civil Administrative Tribunal (VCAT) for the issue of an Enforcement Order, or Interim Enforcement Order.

Reporting a breach

Alleged non-compliances with the Maribyrnong Planning Scheme, Section 173 Agreements, planning permit conditions or endorsed plans should be made in writing attention to Council’s Planning Enforcement Officer and emailed to

The letter should contain:

  • The complainants name, address and contact telephone number (so Council can notify you of the outcomes)
  • The address of the site in question
  • Details of the non-compliance
  • Any other relevant information
